To Stop Illegal Misuse, Abuse & Misrepresentation by Mr. H.S. Awasthi

This Public Notice No. 4 is being put out by Asheet Awasthi to place Public on Alert and to protect the legal heirs of Late Mr. Ameet Awasthi, who died on June 17, 2021, and was a practicing Advocate at District Courts and High Court in Chandigarh, India. Within the last 5 weeks, several deliberate attempts have been made against Late Mr. Ameet Awasthi's legal heirs, in an effort to deny them their legal rights by making false statements. All such actions and inactions are being thwarted in order to protect the assets, property, belongings, and personal effects of Late Mr. Ameet Awasthi which need to be passed on to his legal heirs in accordance with the law. A systematic disinformation campaign has been launched to misguide the public and officials by twisting the facts and withholding the truth with disregard for the law or the consequences. In the same scheme of events orchestrated by our father, Mr. Harnam Singh Awasthi (known as H.S. Awasthi), Advocate, I discovered that he has forged my signatures on one General Power of Attorney (GPA) which he made in his favour (favor) and misused another General Power of Attorney (GPA) without my knowledge, permission or approval, to benefit himself financially at a loss to me. The purpose of GPA is not to cheat or deceive any person, on the contrary it is a document of trust bestowed on another person. Any abuse of it is not only unethical but also illegal. I have advertised in the local Newspapers in Chandigarh to put a Public Notice out for Revocation of Power of Attorney (GPA) documents. This post is deemed to be a Web Publication for Public Information and Notice regarding cancellation of the same.

REVOCATION OF GENERAL POWER OF ATTORNEY (GPA)

LET THIS BE KNOWN TO ALL PERSONS THROUGH THESE PRESENTS that I, Asheet Awasthi, S/o Sh. Harnam Singh Awasthi (known as H.S. Awasthi), R/o 6525 Crown Boulevard, No. 41231, San Jose, California 95160-1231, USA, IInd Address: House No. 1586, Sector 18-D, Chandigarh* do hereby remove and cancel all the powers and authorities given by me to my Father, Sh. H. S. Awasthi, S/o Sh. Suddhu Singh Awasthi i.e.; Rajan Singh Awasthi R/o House No. 1586, Sector 18-D, Chandigarh, by virtue of General Power of Attorney (GPA) Executed & Registered in Estate Office before Estate Officer/Registrar, Sector-17, Chandigarh on 09/04/1997. That the above said executed attorney which was later canceled by me through E-mail on 24/04/2015 and intimation was given to Sh. H.S. Awasthi. However, Sh. H.S. Awasthi misused the cancelled GPA and misrepresented me in February 2018, without any authority, permission, or approval from me. Sh. H.S. Awasthi has also forged my signatures in another General Power of Attorney (GPA) dated 05/05/1993 and registered it on the same day, which is a fake and forged document.   

Therefore, I hereby declare that all deeds, agreements, transfers, registrations, etc., or any of the act done or executed by aforesaid, Sh. H.S. Awasthi S/o Sh. Suddhu Singh Awasthi i.e.; Rajan Singh Awasthi R/o House No. 1586, Sector 18 -D, Chandigarh, under or in pursuance of the aforesaid two (2) General Power of Attorney (GPA) documents dated 09/04/1997 & 05/05/1993, shall not be deemed to be my acts nor done in my name or on my behalf after the cancellation of  GPA dated 24/04/2015 through Email. After the present publication, I want to inform General Public that the above said original GPAs are in possession of Sh. H.S Awasthi stands cancelled and baseless now. If any person deals with Sh. H.S Awasthi related to any type of work which is connected with my name & my cancelled GPAs will be responsible for their loss in future.

WHY WERE THESE NEWSPAPER PUBLICATIONS NEEDED?

As of August 02, 2021, Mr. Harnam Singh Awasthi (commonly known as H.S. Awasthi), Advocate, and our father, is continuing the following actions and wrongdoings. Some of them are unethical while others may be unlawful or even illegal. We will find that out in the course of time. Some of those actions are listed below:

1. HARASSMENT, AGGRESSIVE PRESSURE AND INTIMIDATION: Mr. Harnam Singh Awasthi (commonly known as H.S. Awasthi), Advocate filed a false Police Report, pretended to be a Senior Victim to milk the system and abuse the protection granted by the Government while continuing to think of devious schemes to cause continued harassment, aggressive pressure and intimidation to the legal heirs of Late Mr. Ameet Awasthi. He is likely to abuse and misuse any Power of Attorney (GPA or SPA) in his favour (favor). This is an effort to prevent him and take away his ability to any such wrongdoing while making the public aware of what all he has been doing currently to that end.

2. UNLAWFUL INTERFERENCE WITH PROPERTY AND TENANTS OF LEGAL HEIRS OF LATE MR. AMEET AWASTHI: Mr. Harnam Singh Awasthi (commonly known as H.S. Awasthi), Advocate has visited the tenants of 2 properties in Chandigarh, in which he is not the Owner. He has misguided the tenants and asked them not to pay rent which is supposed to go to the Owners of the property. In one case, rent goes to Late Ameet Awasthi's mother and his son (and Mr. Harnam Singh Awasthi's grand son) because they own that property. Mr. Harnam Singh Awasthi wants to take away that right to the rent from them. As an advocate, he has promised the tenants that he will protect them and fight for them against the legal heirs. He advised those tenants to deliberately default on rent payment and made them commit the crimes of writing bad checks which have bounced for insufficient funds in the bank. These type of actions and such behavior are a good example of unethical misconduct of Mr. Harnam Singh Awasthi as a professional and as an advocate. 

3. FALSE STATEMENTS AND SPREADING LIES: Mr. H.S. Awasthi, Advocate, has made false claims as follows:

   • That the revolver of Late Mr. Ameet Awasthi was a gift he gave him and now he took it back so the revolver has become his revolver, he can sell it and keep the money. (There is a law on gifts and legal procedure for guns which does not define the process as he is stating).

   • That Rs. 50-60 lakhs of money of Late Mr. Ameet Awasthi was stolen from ATM machines on Saturday, June 19, 2021, the day after his funeral by his legal heirs and 1/3rd of that money belongs to him as he is also a legal heir. 

4. FALSE ACCUSATIONS WITHOUT BASIS: Mr. H.S. Awasthi, Advocate, has made false claims as follows:

   • That Late Mr. Ameet Awasthi's car has been stolen, when car had been taken by family for funeral and last rites.

   • That he filed a false Police Report without any evidence or proof and without any basis.

5. FALSE AND BASELESS CLAIMS: Mr. H.S. Awasthi, Advocate, has made false claims as follows:

   • That I have 1/3rd share in Late Ameet Awasthi's car and telling his grandson that he can also get 1/3 money from it.

   • That Late Mr. Ameet Awasthi told him - making several "false" statements to his advantage, on behalf of a person who is no more alive because he knows that person cannot come back to correct his lies or refute his false claims.

6. DISINFORMATION CAMPAIGN: Mr. H.S. Awasthi, Advocate and Pooja Bhardwaj (birth name, Savita Mishra), Advocate, have engaged in a systematic disinformation campaign to misinform and misguide the legal heirs of Late Mr. Ameet Awasthi. They have called on phone repeatedly asking for Authority and Power of Attorney to file False Reports, Complaints and Cases with Police, Executives of the city and the Courts. They have not been given any authority to do anything wrong on behalf of the legal heirs of Late Mr. Ameet Awasthi. Any authority that they were given in the past must be taken away immediately before they can harm the legal heirs further.

7. SUSPECTED COVER UPS TO HIDE MONEY BY TRANSFERING TO OTHERS: Mr. H.S. Awasthi, Advocate is moving large amounts of money in the names of his other relatives hastily. It is suspected that those transfers could be of the money that belonged to Late Mr. Ameet Awasthi, and may be the rightful property of his legal heirs, which are his Mother, his Wife and his Son. It is important that Mr. H.S. Awasthi, Advocate be not allowed to Abuse my Power of Attorney (GPA) in accomplishing his goals. No one trusts him from what he did and caused to his family members in the last 7 weeks.

Mr. H.S. Awasthi, Advocate and Pooja Bhardwaj (birth name, Savita Mishra), Advocate, are absolutely not authorized by any of the legal heirs of Late Mr. Ameet Awasthi or Asheet Awasthi for anything; be it a matter or a transaction or any representation or anything else not mentioned here. Any GPA (General Power of Attorney) given to them in the past, has been canceled (Cancelled). Officials and authorities in Chandigarh Administration have been informed accordingly.  

Whoever deals with Mr. H.S. Awasthi, Advocate and Pooja Bhardwaj (birth name, Savita Mishra), Advocate, does so at his or her own risk. Legal heirs of Late Mr. Ameet Awasthi or Asheet Awasthi do not condone their wrongdoings and are not responsible for any result, outcome, ramifications and/or implications caused by their actions and/or inactions.
